What is the AI Act and who does it apply to?

The AI Act (EU Regulation 2024/1689) is the world's first comprehensive law regulating artificial intelligence systems. It entered into force on 2 August 2024 and applies to all companies using, developing or distributing AI systems in the European Union — regardless of company headquarters location. This includes ChatGPT, AI recruitment systems, chatbots, scoring systems and predictive models.

The AI Act classifies AI systems in 4 risk categories: unacceptable (prohibited from 2.02.2025), high (documentation and oversight requirements), limited (transparency obligations), minimal (no special requirements). Penalties for violations: up to €35 million or 7% of global turnover.

Yes — AI Act applies to all companies using AI in the EU, regardless of size. SMEs have simplified documentation requirements and access to regulatory sandboxes (Art. 62 AI Act). The most important factor is whether you use high-risk AI systems.
Start package: from 11,800 PLN net (1 dept, up to 10 people, 6–8 weeks). Comprehensive: from 37,000 PLN net (2–3 depts, up to 25 people). Enterprise: from 49,000 PLN net (entire organisation). All prices net + 23% VAT.
Maximum penalties: €35 million or 7% of global annual turnover (for using prohibited AI systems). Penalties for high-risk system requirement violations: up to €15 million or 3% of turnover. Penalties for providing false information: up to €7.5 million.
From 2 February 2025, prohibited AI systems include: those manipulating behaviour subconsciously, exploiting vulnerabilities of vulnerable groups, social scoring by public authorities, real-time biometric identification in public spaces (with exceptions), predicting crimes by AI.
AI Act Annex III lists high-risk systems: AI in recruitment (CV screening, candidate evaluation), credit and scoring systems, AI in education (assessments), AI in access to public services, AI in critical infrastructure management, AI in medicine.
ChatGPT as a general purpose model (GPAI) has its own documentation obligations on OpenAI's side. A company using ChatGPT in high-risk processes (HR decisions, credit scoring) must have its own oversight documentation and procedures.
